Social Security Schemes to Gramin Dak Sevaks : A small study

National Union (FNPO & NUGDS) Report to GDS Pay Committee & Directorate :

GDS ar deprived of the State Government welfare/ pension schemes which are available to common man, as the State Govt. consider the working/ discharged GDS as Central Govt.employee and reject their application on this ground.
There are several schemes launched by the Central & State Govt. for housing , health , emoyment etc. But the benefits of these programmes are not reaching to GDS and their family members because of their projected status as a Govt.employee.

For example in Andhra Pradesh & Telangana States , GDS are not eligible for issuing White Ration Card , medical re-embursement schemes like Aarogyasri & NTR Vaidhya Bheema , Housing schemes , childrens educational fee re-embursement , Old age pension etc. which were provided to all COMMON MAN living in these both States.

Therefore we are in the view , that the Central and State Governments not treated GDS as a COMMON MAN also.

Department View :

The GDS are not covered under CCS (Pension ) Rules,1972 and therefore , they are not entitled for any pension,GPF and other benefits . So, DoP has sympathytically designed some social security schemes to GDS i.e. Sevarance now called as Service Dischage Benefit Scheme (SDBS) ,Gratuity,Group Insurance etc.

Sevarance ( SDBS ):

For each completed year of service @1500/- up to 2011 and there after SDBS scheme is introduced . At present maximum amount payable to GDS to this scheme is Rs.60,000/-

Ex-Gratia Gratuity :

At present maximum amount payable to GDS to this scheme is Rs.60,000/-

Group Insurance Scheme : 

At present insurance coverage of Rs.50,000 with a monthly subscription of Rs.50 is available to all GDS. But it is not a attractive scheme when compared to PMJJBY.

Committee Recommendations :

In the above said two schemes , the GDS Committee recommended 1.5 Lakh to Sevarence amount with delinking the SDBS and 5 Lakhs to Gratuity.GIS recommended for 5 Lakhs with a monthly subscription of Rs.500.

But according to latest information, Severance & gratuity schemes are recommended @1.5 Lakh by the Greatest Departmental Committee who knows everything about GDS System and also who are enjoying on the slavery deaths of GDS.No change of insurance coverage of Rs.50,000 in case of GDS GIS.

Conclusion :

Rules must made according to Labour Laws and Constitution of India

But, not with in the four walls of the AC ROOM according to Department wish.

Sub: Regarding creche rules to be framed under the Amended Maternity Benefit Act, 1961
Sir,
The Maternity Benefit Act was amended to provide creche facilities in the Establishments employing 50 or more employees. For effective implementation of this provision, it is necessary that Rules are framed prescribing amenities and facilities required to be provided in said creche. The Act provides that appropriate Government shall frame such Rules. The State Governments are appropriate Government under the Act for Establishments other than Mines and Circus.
2. lt is, therefore, requested that State Governments may take immediate action to frame and notify Rules for the creche facilities as the provision of creche of amended Act is already in effect from 1st July 2017.

TWO DAYS RELAY HUNGER FAST IN FRONT OF ALL DIVISIONAL OFFICES ON 28th & 29th NOVEMBER 2017

Dear Comrades,

The NFPE Federal Secretariat decided to continue the struggle programme on long pending charter of demands.
In the first phase, it is decided to conduct two days relay hunger fast infront of all divisional offices on 28th & 29th November 2017 with en mase participation of NFPE & AIPEU-GDS members. 

During the programme, it is requested to wear black badges / badges with demands with out fail.

Make the programme a grand success and report compliance to the respective CHQs at the earliest.

GDS Conduct & Engagement Rules, 2011 : Rule 3A (iii) - Overview

Rule : A Sevak shall have to give an undertaking that he has other sources of income besides the allowances paid or to be paid by the Government for adequate means of livelihood for himself and his family.

Committee views :

• The Committee also found out during the visit to Circles that this condition is not being implemented in letter and spirit and merely exists on paper in most of the cases.

• This conditon exists in paper only.
• The declarations given by GDS were mostly not correct.

• No action has been taken by the Dept.for submitting incorrect declarations.

• How alternative means of livelihood is available to GDSs who come to work from outside the post village due to changed residence condition ?

• The employeers who hire labours for different works in the rural areas ,will not hire GDSs for 2-3 hours in a day after working hours of GDS Post Office.

• A large percentage of GDSs are now solely dependent upon the wages which they receive from the Department.

Finally, the Committee feels that this condition needs to be changed appropriately which suits the requirements of the Department as well as GDSs.

Department View :

• After examining all these issues, Directorate dont want to made any changes in this rule and hence they are in the view that " the maximum working hours is restricted to 5 hours according to Rule 3A(i) , there is no logic seen in taking away this condition.

NUGDS(FNPO) stand :
• Both these rules i.e, 3A(i) & 3A(iii) are interlinked 

• We submitted and proved before Kamalesh Chandra Committee and Directorate that " majority of GDS were performed their duties beyond 5 hours with the standards of workload norms assigned by DoP & upto 10 to 15 hours by including MGNREGS and Social Security Pensions.Hence, requested the DoP to provide 8 hour duty to all GDS.


If 8 hours duty provided to GDS by DoP, there is no need to take declarations from GDS for other sources of income.
(or) 
It is evidently proved by the GDS Pay Committee Report , that" this rule exists in paper only".

Conclusion :

There fore, we ask, request and demand the abolition of GDS Conduct & Engagement Rules,2011 for better livelihood of India Post.

Respected Sir,
I submit this article for the information of our valuable readers of PoTools and action at appropriate level.

This is in continuation of my articles in our PoTools under the title “Cases for consideration by the Anomaly committee-1 and 2” “ already published - Click Here

In that article I suggested that “for option for pay fixation on the date of next increment, for the period between the date of promotion and the date of next increment, the pay should be fixed at the cell in the promoted level which is just higher to the pay in the lower level”
I am happy that the government has accepted this and orders are issued vide Ministry of Personnel, Public Grievances and Pensions, Department of Personnel & Training no. 13/02/2017-Estt.(pay-I) dated 27.7.2017. para 3(ii) reads as follows.

“In case, consequent upon his/her promotion, the Government servant opts to have his/her pay fixed from the date of his/her next increment (either 1st July or 1st January, as the case may be) in the level of the post from which Government servant is promoted, then, from the date of promotion till his/her DNI, the Government servant shall be placed at the next higher cell in the level of the post to which he/she is promoted.”

I congratulate everybody who took this case for settlement. All officials who were promoted till the date of issue of the above orders should be given another opportunity for pay fixation on promotion. This is because; those officials might have opted for promotion from the date of promotion itself, as there was no benefit between the date of promotion and DNI.

But, still another thing is to be settled. This article is about this issue. On promotion, a section of employees are losing some benefits, especially from level 6 to 7, and 7 to 8, comparing promotion of employees between other levels. Level 6 to 7 represents MACP III in Department of Posts. Here are the details.

Prior to 6th CPC there were scales of pay for various cadres. For an official who opted for pay fixation on the date of next increment, the official was placed at the next higher stage of the promoted scale from the date of promotion to the date of next increment. On the date of next increment, his pay was fixed in the promoted scale at a stage which was next higher to the figure arrived at by adding one increment in the feeder scale, subject to a minimum of Rs. 100.

After 6th CPC the scales were replaced by pay band and grade pay. In this case also, for an official who opted for pay fixation on the date of next increment, the official was given the difference of grade pay for the period between the date of promotion and DNI. On the date of increment, the official was given one increment and the difference of grade pay from DNI.

From the above it could be seen that, the promotion offered financial benefits in two forms, one by way of increment and another by way of placement in the higher level (5th CPC) or difference of grade pay (6thCPC).

Rule 13 of CCS (RP) Rules 2016 stipulates the method of fixation on promotion, which is reproduced below.

“The fixation of pay in case of promotion from one level to another in the revised pay structure shall be made in the following manner, namely:-

(i) One increment shall be given in the level from which the employee is promoted and he shall be placed at a cell equal to the figure so arrived at in the level of the post to which promoted and if no such cell is available in the level to which promoted, he shall be placed at the next higher cell in that level.

From the pay matrix it can be observed that the levels of 6 and 7, 7 and 8 are identical. As a result, the officials who are promoted from levels 6 to 7 and also 7 to 8 are the losers as their pay will be fixed in the cell which would be equal to the amount in the lower level after addition of one increment. For all other levels, the officials would be fixed in the next higher cell of the promoted level. As such a section of employees will be put into loss on promotion. They will get the benefit of one increment only but nothing for the change in the level. This is an anomaly. In order to ensure equal benefit to all officials on promotion, the following is suggested.
Remedy suggested:

Since the pay matrix resembles the pay scales which existed prior to 6th CPC, each level represents a scale, next level represents the promotional scale, the rules existed at that time, 5th CPC orders are applicable at this stage.

In Rule 13 of CCS (RP) Rules 2016, the following words to be deleted. “Equal to the figures so arrived at in the level of the post to which promoted and if no such cell is available in the level to which promoted”.

The rule should be modified as follows.
“ one increment shall be given in the level from which the employee is promoted and he shall be placed at the next higher cell to the figure so arrived at in the level of post to which promoted,”
This will maintain uniform benefits to all employees on promotion.
This may be taken at appropriate level and revised orders may be caused to be issued so that all officials are extended the same amount of benefit on promotion.

Government to examine Rs.5 lakh tax exemption proposal for pensioners

The finance ministry has informed Congress MP Shashi Tharoor that his suggestion to increase the tax exemption limit for pension up to Rs 5 lakh would be examined during the ongoing preparations for the Union Budget 2018, according to a communication.

Responding to a letter written by Tharoor in late September, Minister of State for Finance Shiv Pratap Shukla said the suggestion that pension up to Rs 5 lakh per annum should be exempted from income tax in all cases was examined.
"The proposal would be examined during the exercise for the ensuing Union Budget 2018 and the outcome would be reflected in the Finance Bill, 2018," said the letter, which was tweeted by Tharoor.
The letter, dated November 14, said that a pensioner who is above 80 years is not required to pay tax if the total income, including pension, does not exceed Rs 5 lakh.

"The suggestion that pension up to Rs 5 lakh per annum should be exempt in all cases would require amendment to the existing provisions of the Income Tax Act, 1961," the letter said.

A pensioner, who is a senior citizen - aged 60 to 80 years - is exempt from income tax if the income, including from pension, does not exceed Rs 3 lakh.

About the letter, Tharoor tweeted, "Govt's semi- encouraging reply to my request to exempt pensioners from tax on the first 5 lakhs of income. Hope @arunjaitley will include this in his next budget".

The work for preparation of the General Budget has already commenced and Finance Minister Arun Jaitley is likely to present it to Parliament in the first week of February.

This excel file has been designed to print slips (containing Auto - generated random Barcode numbers) for supplying to trainees (to practice/ Hands on training in POS, IPVS, DPMS). 
Maximum of 50 slips can be printed at a time. New set of Barcode numbers will be automatically generated for printing whenever the excel file is closed and re-opened again.
Wastage of Barcode sticker labels/Bag tag labels in CSI UC/EU trainings can be avoided.
Trainer has to enter No. of trainees for whom slips are to be printed. 
Based on circle, Barcode prefix can be changed by Trainer to generate barcode numbers accordingly.

No Proposal Under Consideration to Withdraw Bank Chequebook Facility

In a section of the media, it has appeared that there is a possibility that the Central Government may withdraw bank cheque book facility in the near future, with an intent to encourage digital transactions. It is denied that there is any proposal under consideration of the Government to withdraw bank cheque book facility. 
In this regard, it is emphasized that while the Government is committed to transform India into a less cash economy and promote digital and electronic transactions through multi-pronged initiatives, cheques are an integral part of the payments landscape, and form the backbone of trade and commerce, by being negotiable instruments, which often serve as the security for underlying trade transactions. 

In fact, the Union Finance Minister, in the Budget Speech 2017-18, had announced, “As we move faster on the path of digital transactions and cheque payments, we need to ensure that the payees of dishonoured cheques are able to realise the payments. Government is therefore considering the option of amending the Negotiable Instruments Act suitably.”
