7th Pay Commission: Committee on Allowances likely to present its report today
The Committee on Allowances, headed by Finance Secretary Ashok Lavasa, was given time till February 22 to present its report.
It has been nearly eight months since the Narendra Modi government cleared the recommendations of the Seventh Pay Commission .

After a long wait, the Committee on Allowances is likely to submit its report to Finance Minister Arun Jaitley on Monday.

The committee, headed by Finance Secretary Ashok Lavasa, was given time till February 22 to table its report.
The revised allowances are likely to be effective from April 1.
The house rent allowance (HRA), which forms a crucial part of government employees' salary, is expected to be fixed at 30 per cent of the basic pay for employees in metros which have a population of 50 lakh and above.

HERE IS ALL YOU NEED TO KNOW:

  • The Seventh Pay Commission had recommended 24 per cent of the basic pay as HRA against the 30 per cent of basic pay under the Sixth Pay Commission.
  • The Committee on Allowances was formed in July last year to review the recommendations of the pay commission after employees protested against the proposed slash in the HRA. The pay commission also recommended doing away with 53 of the 196 allowances and merging a few others.
  • The committee was initially given four months to table its report, which was later extended to February 22, 2017. If reports are to be believed, the Central government is likely to move ahead with the committee's report after March 15 when Assembly elections will be over.
  • If the government decides to pay a 30 per cent of basic pay as HRA to its employees, the cost estimate comes to Rs 29,300 crore in the first year.
  • The hiked salary is given in two parts to government employees, in the form of basic pay and allowances.
  • While the increase in basic pay is calculated on a back-date basis, making employees eligible for arrears, the hike in allowances is applicable from the date the government implements it. As a result, employees are not entitled to arrears in this case.
  • It is widely believed that the government has effectively saved a lot of money this financial year by not making an announcement on allowances. Government employees, on the other hand, have expressed their disappointment over being denied their full remuneration over a prolonged period.

Weekly Cash withdrawal limit for savings account increases to Rs. 50,000

Savings accounts holders will now be able to withdraw up to Rs 50,000 per week with effect from today.
An RBI notification, issued on January 30, had announced that from February 20 the cash withdrawal limit for savings accounts will be raised to Rs 50,000 from Rs 24,000 a week.

The limits on cash withdrawals from savings bank account will be withdrawn completely from March 13.

Till now, there is no limit on current account and there is a cap of Rs 50,000 for farmers a week and Rs 2.5 lakh for marriage.

CHQ News:GS visits Directorate

GS and CHQ Treasurer visited Directorate on 16-2-2017 and 17-2-2017 and met with senior officers and discussed the following cases with them.

1.   Issue of final combined seniority list of Inspector Posts cadre for the year 2001 and 2002 and remaining years.

Directorate vide memo No. 7-1/2015-SPB-II dated 17/5/2016 has circulated draft All India combined seniority list of Inspector Posts for the year 2001 and 2002 and requested to intimate discrepancies noticed therein. Thereafter Directorate vide Memo No. 7-1/2015-SPB-II dated 09th June 2016 has again circulated revised seniority list to all HOCs with a direction to circulate among all the candidates for inviting comments/grievances. In response to above letters huge number of representations are said to have been received at Directorate and most of them are examined at SPB Division in the light of DoPT OM No. 28011/6/76-Estt (D) dated 24.6.1978 and 20011/8/2012-Estt (D) dated 04-03-2014. Now, file is under preparation for seeking clarification from DoPT. After receipt of clarification from DoPT, final seniority list will be circulated and thereafter on the same line, remaining years seniority lists will be prepared.

2.   Holding of supplementary DPC for promotion to the cadre of PS Gr. B for the year 2016-17.

Directorate vide Memo No. 9-14/2016-SPG dated 09-12-2016 has appointed 105 Inspector Line Officers on regular basis in PS Gr. B cadre, but few circles have yet not implemented orders. Further few circles have not submitted the report on joining as well declination by the promote officers to SPG section of Directorate. Till date only 5 declinations are said to be received from officers. Directorate is going to remind all HoCs soon to submit clear report on joining / declination of officers and thereafter supplementary DPC will be convened.

3.   Issue of revised Recruitment Rules for the post of Assistant Manager in MMS and filling up of vacant post of Dy. Manager MMS.

RRs are said to finalised. Two posts of Dy. Manager MMS are vacant and it will be filed up soon.

4.   Inter Circle Rule 38 transfer cases of Inspector Posts cadre.

Most of the cases settled. Due to non availability of vacancies in few circles, the requests of the candidates are pending and these will be considered when vacancy occurs.  The individual candidate/s may take up issue through proper channel to Directorate. Their cases will be considered on availability of vacancies in the circle.

5.   Holding of periodical meeting with Hon’ble Secretary (Posts).

Agenda already submitted by Association. Reports from DDG (P) and Sr. DDG (Vig) awaited. Asked to write reminder.

6.   Clerical Assistance to Sub Divisional Head.

SPG Division has called for report from Establishment Division. The matter is under examination at Establishment Division.

7.   Declaration of result of Inspector Posts examination for the vacancy year 2015-16.

LDCE for promotion to the cadre of Inspector Posts (66.66%) departmental quota for the year 2015-16 was held on 22 and 23-10-2016 for 189 vacancies (OC-155, SC-26 and ST-8). The provisional key of the question papers was already published by the Department on India Post website and representation thereon if any was called for from candidates till 6-1-2017. Huge quantity of representations are said to be received from candidates. Department have already formed committee to examine all the representations received from candidates. The report from committee is yet to receive at Directorate. FINAL KEY will be expected thereafter. To clear all these exercise, minimum one month’s time is required.

8.   Declaration of result of PS Gr. ‘B’ examination for the vacancy year 2012-13 to 2015-16.

Many representations are received thereon and all these are under examination. To examine the representations received from candidates, department is going to form a committee who will examine the representations and give final report to Department. Thereafter FINAL KEY will be published on department’s website. It is told that there are many CAT cases registered at various benches and they stayed declaration of results till outcome. In one case stay is said to be granted till April 2017.


9.   DPC for holding of JTS Gr. A promotion for the year 2016-17 and repatriation thereof.

UPSC has raised query and same is being replied soon by the department. Earlier it was told that there were 11 vacancies but now there is chance to increase. The officers who have completed two years of service will only get repatriation to his/her parent circle. Spouse category cases are also said to be considered this time.

Many other pending cases related to cadre are discussed with the concerned officers. The case of cadre restructuring is also discussed at length and the officers have shown positive to our proposed proposal. The proposal is being submitted soon.

India Post eMail Server Error and Suggestion to Fix the Problem

When the user tries to connect via outlook they can't get connected to the server and when I try to login on OWA I get the following error:

To resolve this issue, please use the following steps: (This Suggestion to TCS & This modification should be done in Central Server by TCS. here published for information only)
1. By using the command “Get-MailboxStatistics -Identity AliasName |fl” obtain the following mailbox settings:
a. Database
b. MailboxGuid
c. ServerName
2. By using the command “Get-MailboxDatabase -Identity “DataBaseName” |fl” obtain the following database settings:
a. Guid

3. Launch the Registry editing tool (“Regedit”) in the Exchange 2010 server that hosting the user mailbox and navigate to:
“HKEY_LOCAL_MACHINE\SYSTEM\CurrentControlSet\services\MSExchangeIS\%ServerName%”
4. Under the registry key (that was opened in step “3”), find the database GUID (that was obtained in step “2”, e.g. Private-dad6b75a-f6df-42c6-b1c4-8c63c5ef123f”, when the database GUID represent in the suffix behind the “Private-“.

5. Navigate to “QuarantinedMailboxes” registry key:

​Are arrears of salary taxable? – Income Tax FAQ

What is considered as salary income?

section 17​​ of the Income-tax Act defines the term ‘salary’. However, not going into the technical definition, generally whatever is received by an employee from an employer in cash, kind or as a facility [perquisite] is considered as salary.

​What are allowances? Are all allowances taxable?

Allowances are fixed periodic amounts, apart from salary, which are paid by an employer for the purpose of meeting some particular requirements of the employee. E.g., Tiffin allowance, transport allowance, uniform allowance, etc.

There are generally three types of allowances for the purpose of Income-tax Act – taxable allowances, fully exempted allowances and partially exempted allowances.​

​My employer reimburses to me all my expenses on grocery and children’s education. Would these be considered as my income?

​Yes, these are in the nature of perquisites and should be valued as per the rules prescribed in this behalf.​​

​During the year I had worked with three different employers and none of them deducted any tax from salary paid to me. If all these amounts are clubbed together, my income will exceed the basic exemption limit. Do I have to pay taxes on my own?
​Yes, you will have to pay self-assessment tax and file the return of income.​

​Even if no taxes have been deducted from salary, is there any need for my employer to issue Form-16 to me?

​​Form-16 is a certificate of TDS. In your case it will not apply. However, your employer can issue a salary statement.​

​Is pension income taxed as salary income?

​Yes. However, pension received from the United Nations Organisation is exempt.​​

​Is Family pension taxed as salary income?

​No, it is taxable as income from other sources.​

​If I receive my pension through a bank who will issue Form-16 or pension statement to me- the bank or my former employer?

​​The bank.​

​Are retirement benefits like PF and Gratuity taxable?

​​In the hands of a Government employee Gratuity and PF receipts on retirement are exempt from tax. In the hands of non-Government employee, gratuity is exempt subject to the limits prescribed in this regard and PF receipts are exempt from tax, if the same are received from a recognised PF after rendering continuous service of not less than 5 years.​

​Are arrears of salary taxable?

​​​​Yes. However, the benefit of spread over of income to the years to which it relates to can be availed for lower incidence of tax. This is called as relief u/s 89​ of the Income-tax Act.​​

​Can my employer consider relief u/s 89 for the purposes of calculating the TDS from salary?

​​Yes, if you are a Government employee or an employee of a PSU or company or co-operative society or local authority or university or institution or association or body. In such a case you need to furnish Form No. 10E to your employer. ​​

​My income from let out house property is negative. Can I ask my employer to consider this loss against my salary income while computing the TDS on my salary?

​Yes, however, losses other than losses under the head ‘Income from house property’ cannot be set-off while determining the TDS from salary.​​

​Is leave encashment taxable as salary?

​​It is taxable if received while in service. Leave encashment received at the time of retirement is exempt in the hands of the Government employee. In the hands of non-Government employee leave encashment will be exempt subject to the limit prescribed in this behalf under the Income-tax Law.​

​Are receipts from life insurance policies on maturity along with bonus taxable?​

As per section 10(10D), any amount received under a life insurance policy, including bonus is exempt from tax. However, following receipts would be subject to tax:
  • Any sum received under sub-section (3) of section 80DD; or
  • Any sum received under Keyman insurance policy; or
  • Any sum received in respect of policies issued on or after April 1st, 2003, in respect of which the amount of premium paid on such policy in any financial year exceeds 20% (10% in respect of policy taken on or after 1st April, 2012) of the actual capital sum assured; or
  • Any sum received for insurance on life of *specified person (issued on or after April 1st 2013) in respect of which the amount of premium exceeds 15% of the actual capital sum assured.
* Any person who is –

i) A person with disability or severe disability specified under section 80U​; or

ii) suffering from disease or ailment as specified in the rule made under section 80DDB.

Following points should be noted in this regard:
Exemption is available only in respect of amount received from life insurance policy.
Exemption under section 10(10D)​ is unconditionally available in respect of sum received for a policy which is issued on or before March 31, 2003.
Amount received on the death of the person will continue to be exempt without any condition.​

Rulings for Issuing Duplicate NSC Certificate at Post Office Counter

1. Filled Form-NC29 for the Issue of Duplicate Certificate

2. Statement showing the details of NSC– such as number, amount and the date of certificate and the circumstance attending such loss, theft, destruction, mutilation or defacement.
3. Bond of Indemnity – In case of mutilated or defaced certificates, no indemnity bond is required. But for lost, stolen, destroyed, you also need to submit bond of indemnity. You also need to furnish an indemnity bond in the prescribed form with one or more sureties or with a bank guarantee is required.
A- Bond of Idemnity (Form NC-54(a))
This form is used for issuance of a duplicate National Savings certificate(s) in lieu of lost, misplaced, spoiled or mutilated certificates.
B- Bond of Idemnity (Form NC-54(b))
This bond of indemnity is to be executed for the issue of a duplicate certificate(s) in lieu of lost, misplaced, spoiled or mutilated certificates with a Bank guarantee.
C- Bond of Indemnity (Form NC-61)
This bond of indemnity is to be executed at the time of discharge of original certificates or Issue of duplicate certificate(s) in lieu of lost, misplaced, spoilt, destroyed, defaced or mutilated certificate (s), where original application for purchase is missing.
4. Copy of FIR – If the Certificate is lost, stolen, destroyed.

5. Identification Document of Surety – e.g. Valid Indian Passport, Indian Driving License, Salary Certificate of the Surety.

6. Payment Receipt of Fees for Issue of Duplicate Certificates (Fee Rs.5)

If the officer-in-charge of the post office of registration is satisfied of the loss, theft, destruction, mutilation or defacement of the certificate, he shall issue a duplicate certificate on the application.

Things you should Know

A duplicate NSC certificate shall be treated as equivalent to the original certificate for all the purposes of these rules except that it shall not be encashable at a post office other than the post office at which such certificate is registered without previous verification.

“VERY GOOD” BENCH MARK FOR MACP AND DENIAL OF PROMOTIONAL HIERARCHY

Eversince, the MACP scheme was introduced in 2008, confederation and the JCM staff side has been demanding promotional hierarchy instead of grade pay hierarchy. Govt, instead of considering this genuine demand, suddenly issued orders imposing “very good” bench mark condition for MACP. The JCM staffside was not even consulted. JCM staff side, secretary wrote a letter to cabinet secretary on 28-07-2016 as follows:
“The Govt. has accepted one of the adverse recommendations of 7th CPC without holding any consultation with the staff side. The recommendation of the 7th CPC regarding bench mark for performance appraisal for promotion and financial upgradation under MACPs, to be enhanced from “Good” to “very good”, has been accepted by the Govt. without considering the implication on the morale of the Central Government employees… We are of the firm opinion that Govt. should reconsider their decision on the above issues and we request you to kindly withdraw the same.”
Subsequently the case was discussed in the JCM standing committee meeting also on 25-10-2016, as an agenda item given by staff side. Inspite of all these, the Government is not ready to withdraw or modify the orders.

This shows the attitude of the BJP led NDA Govt. towards JCM staff side and Central Govt. employees.

Apply for passports at select post offices from next month

The External Affairs Ministry is making all required arrangements for roll-out of the scheme in some of the select cities in first half of March.
From next month, people in select cities will be able to apply for passports in post offices under an ambitious initiative of the External Affairs Ministry. This is aimed at making the passport issuance process hassle-free and ease burden on passport offices across the country which are grappling with large volume of applications. In the first phase of the project, passport services will be made available in select post offices in Rajasthan, West Bengal, Tamil Nadu, Karnataka and Jharkhand and some other states.
The External Affairs Ministry, which issues passports, is making all required arrangements for roll-out of the scheme in some of the select cities in first half of March. Currently, 89 Passport Seva Kendras (PSK) are operating across the country as extended arms of the 38 Passport Offices. According to the MEA, the government rendered 1.15 crore passport and other related services during 2016.
In Rajasthan, passport services will be available in Kota, Jaisalmer, Bikaner, Jhunjhunu and Jhalawar while in West Bengal it will be in Asansol, Nadia, North Dinajpur North Kolkata. In Jharkhand, services will be offered in Deoghar, Jamshedpur and Dhandbad. “It is our effort that Post Office Passport Sewa Kendras announced in the first phase should start functioning before 31.3.2017,” External Affairs Minister Sushma Swaraj tweeted.
In Tamil Nadu, passport services in post office will be rolled out in Salem and Vellore while in Karnataka, it will be in Belgaum, Davangere, Hassan, Gulbarga and Mysuru. According to MEA, the objective of the government has been to cater to the demand for passports and to reach out to the people located far away from the passport offices. The MEA had recently liberalised norms for certain categories of citizens as part of efforts to streamline the passport issuance process.

Contempt Petition regarding upgradation of Grade Pay of Inspector Posts w.e.f 01.01.2006 - Updates

All our members are well aware that Association has filed Contempt Petition bearing No. C.P/180/00137/2016 before Hon'ble CAT Ernakulam Bench in OA No. 180/00289/2013 regarding up-gradation of Grade Pay of Inspector Posts w.e.f 01.01.2006.

The copy of Affidavit filed by Mr Abhay N Sahay (the representative of respondent) Under Secretary in the Implementation Cell, Department of Expenditure, Ministry of Finance in reply to our Associations Contempt Petition and thereafter copy of Affidavit filed by Association (Petitioners/Applicants) are placed herewith for kind information of members. CHQ has continue fight till to achieve the desired goal and therefore Association need money. 

All IP/ASPs and Offg. PS 'B' officers took good amount of arrears of 7CPC and many assured that they will willingly donate the amount to CHQ, but response is very very poor. Now-a-days, everyone is asking about the progress of cadre restructuring. Except few, no one is helping CHQ. 

The Association has already appealed to all members to donate some money (not less than Rs.1000/-) to CHQ to strengthen the fund but there was very few response received from members.
