Subject: - Clarification on Department of Posts Postman and Mail Guard (Group 'C') Recruitment Rules, 2018.

Madam / Sir,

In this regard, a few Circles have sought clarification on certain points, which are clarified as under:-

1. Circle/ Issue -
Andhra Pradesh, Haryana, Karnataka: Whether the educational and other qualifications (Knowledge of computer Language and possessing valid driving license of two-wheeler) required for direct recruits detailed in column 7 of RRs of Postman/Mail Guard is applicable for GDS candidates (direct recruitment).

Andhra Pradesh: Whether the candidates having two wheeler license only should be allowed for examination/ selection OR can license be obtained afterwards.

A common examination may be held across the Circle for filling up of vacancies of Postman/ Mailguard from both MTS and GDS.

In case preference is exercised for a limited number of units and could not be allocated to one of those units as per merit vis a vis vacancy in the category he/ she belongs to, he/ she will not be considered for other recruiting units not preferred even though a candidate lower m rank to him/ her is considered who has opted for that unit.
Order of preference once exercised shall not be changed. Preparation of Merit List and allocation of Division

a. At first, two merit lists for each division/recruiting unit shall be prepared for Qualified candidates

Clarification:
O.M No. AB.14017/13/2013-Estt.(RR)(1349) of Department of Personnel & Training (DOPT) states as under:-

"The legal position is that the posts are to be filled up as per - the eligibility conditions prescribed in the Recruitment Rules in force at the time of occurrence of vacancies unless the Recruitment Rules are amended retrospectively. The practice has however been to give effect to the Recruitment Rules prospectively."

Further, clarification has already been issued vide letter number 37-10/2002-SPB-I dt. 14.11.2002 which states as follows-
"According to cannons of la w, the recruitment rules in force at the time of occurrence of vacancies whatsoever be the date of notification, should be followed. "

Accordingly , vacancies upto the vacancy year 2017 (April 2017 . March 2018) are required to be filled up as per the Postman and Mailguard, Recruitment Rules, 2010, and vacancies occurring in 2018 vacancy year (April - December 2018) and thereafter are required to be filled up as per Recruitment Rules of 2018 notified on 20.09.2018.

6. Circle/ Issue -

Clarification:
Point No. (iii) under column 10 of the Schedule of Department of Posts (Postman and Mailguard) Recruitment Rules, 2018 may be referred to in this regard. Only those GDS who have worked regularly for five years in that capacity as on the 1st day of January of the year to which the vacancy (ies) belongs are eligible.

7. Circle/ Issue -
Rajasthan Circle: In the RRs of Postman and Mail Guard, it is mentioned that age and educational qualifications prescribed for direct recruits will not apply in the case of promotees. However, there is no mention about the other qualifications in the column no. 8 of RRs as mentioned in column no. 7.

Clarification:
Observations of the Circle have been noted. Amendment of Department of Posts Postman and Mail Guard (Group 'C') Recruitment Rules (RRs), 2018 to this extent is under consideration.

Till further revision of RRs, other qualifications may not be made applicable for considering promotion.

8. Circle/ Issue -
Karnataka Circle: To provide SOP for departmental examination.

Clarification:
SOP for Departmental Examinations is under process.

2. The above clarifications may be brought to the notice of all concerned and action taken to conduct DPC/Examination for promotion/appointment to the cadre of Postman/ Mail Guard at the earliest.

Yours faithfully,

Conditions for OTA:

The grant of OTA may be linked to biometric attendance subject to the conditions mentioned below.

a) OTA should be paid only when his/ her senior officer directs the concerned employee(s) in writing for staying back in office to attend urgent nature of work.

The OTA will be calculated on the basis of biometric attendance.

The OTA for Staff Car Drivers should be linked with biometric system as normally, the designated parking is allotted in the office building. Subject: Rotational transfer - Clarification

Sir/Madam,

I am directed to refer to Directorate's communication number 141-141/2013- SPN-11 dated 17.01.2019 vide which revised 'Guidelines for transfer' was circulated to all Postal Circles. References were received from various Postal Circles / Service Associations pointing out some difficulties and seeking clarifications. The references have examined and clarified as under:

Clarification 1:
Whether continuous service rendered by an employee in different cadres at a particular station is to be counted cumulative for station tenure of 6 years or not.
As per the provision of station tenure, officials who are working at a particular station for a period of 6 years or more has to be transferred/rotated outside that station. Service rendered at a particular station in all cadres (PA, LSG, LSG-II, HSG etc.) will be counted for the purpose.
2. Whether the rotational transfer will also be followed in RMS Wing
Vide communication no. 12.1/2019-SPN II dated 07.05.2019 Group 'C' 6848 officials have been exempted from the provision of 6 years of station tenure. In respect of other officials rotational transfer will apply.

3. Exempt the officials appointed on compassionate ground from the condition of probation period or 2 years of regular service while considering their request for transfer under Rule-38 as they are appointed to support their family.
Officials appointed on compassionate ground are appointed against the vacancy of Direct Recruitment. There is no separate quota of vacancy for compassionate appointment. Therefore, such officials shall not be exempted from the condition of probation period of 2 years of regular service while considering their request for transfer under Rule-38.
4. Whether the officials who completed six years of station tenure but not completed Post tenure shall be transferred.
Official who complete station tenure or six years but does not complete post tenure will also be transferred as per guidelines
5.Transfer of officials in city centric Divisions whore minty of the officials working in City cannot be accommodated in remaining jurisdiction of the Division i.e. outside the city. The application of 6 years of station tenure on Group 'C' officials will create so many problems administratively including huge expenditure en TA.
The provision of Station tenure of six years will normally not be enforced to PA / LSG / HSG-II / HSG-I officials except ordered m administrative interest and under exigencies of service. However sufficient number of willing officials from a particular station to other station and vice-versa are available, station transfer must be carried out on completion of station tenure of 6 mars and in such circumstances official(s) with longest tenure at a particular station will be transferred.
6.Application received prior to 17.01.2019.

Transfer request application received upto 31.12.2018 in respect of earlier guidelines dated 31.07.2018 and transfer request received between 01.01.2019 to 16.01.2019 which has not been processed, shell be treated as to be received between la April 306, June and shall be dealt accordingly.
7.Whether temporary transfer can be considered when the disciplinary ease is pending/contemplated?
If any vigilance case / disciplinary proceeding is pending against an official then his / her case shall not be considered for temporary transfer.
